Representation flags concerns over tender compliance, product track record and accountability; seeks strict adherence to NBCC-approved make list

Noida: Questions have been raised over the reported use of licensed products in place of materials specified in the approved make list for various Amrapali projects being executed under NBCC.
A representation submitted to the concerned authorities has alleged that some contractors are considering products manufactured under licensing arrangements instead of the brands specified in the tender. It has urged the authorities to ensure that procurement remains strictly in line with the approved make list and technical specifications.

Concern over newly introduced products
According to the representation, some of the licensed products being considered are relatively new to the Indian market and do not have an established installation record in major government or private projects.
The representation has questioned whether products with limited project history should be used in large-scale housing projects without adequate assessment of their long-term performance, durability and technical suitability.

The representation has also raised questions over responsibility in the event of a manufacturing defect or quality-related discrepancy.
It claims that under the licensing arrangement cited in the representation, the principal company may not assume responsibility for manufacturing or quality issues involving products manufactured by the licensee.
This, it argues, could create uncertainty over accountability if a product fails to perform as expected after installation.
Tender compliance under scrutiny
The representation states that the NBCC tender documents specify approved makes for various construction materials. Publicly available tender records for Amrapali-related works also include documents titled “List of Approved Makes” among the tender documents.
The issue, therefore, centres on whether a licensed product manufactured by another company can be used in place of a product specifically identified in the tender, and whether such substitution complies with the applicable tender conditions and technical specifications.
Request for directions to contractors
The company that submitted the representation has requested the authorities to issue directions to contractors associated with the projects to purchase and use materials strictly according to the NBCC-approved make list and tender specifications.
It has also highlighted the need for clear documentation regarding product approvals, technical compliance, quality standards and responsibility for any future defects.
Why the issue matters
The Amrapali projects are being executed under NBCC following intervention in the stalled housing projects. NBCC’s own records say that multiple Amrapali projects are under execution and that the company has been working to complete and hand over homes to buyers.
Against this backdrop, the representation argues that adherence to approved specifications and clarity over product responsibility are important for ensuring quality and avoiding disputes at a later stage.
